City, police sued in man’s shooting death

A $5 million wrongful death lawsuit has been filed against the Levelland Police Department for the shooting death of a man here last January.

The suit was filed on behalf of Emilia Espinoza, the widow of Jose Antonio Espinoza, who was fatally shot by two police officers the morning of Jan. 23, 2015.

It was filed last month in the U.S. District Court for the District of Northern Texas by Colorado attorney Normando R. Pacheco.

The defendants are two police officers, John Doe 1 and 2, Police Chief Toney Cowan and the City of Levelland.

The lawsuit charges that the two officers ‘unjustifiably shot and killed’ Espinoza and used ‘excessive deadly force.’
